A full utility patent application has been filed with the U.S. Patent Office.  International patent applications have also been filed. These patents claim the novel and non-obvious use of MC-1101 for the treatment of AMD and related eye diseases. MacuCLEAR’s product portfolio also consists of at least eleven additional compounds all of which are covered in the existing patent applications. The Company has a current “freedom to operate” opinion from the technology counsel at TAMU, which has performed extensive research (e.g. patent searches, variations) to determine there is no existing compound like MC-1101 in the patent system. MacuCLEAR expects to receive the full patent by the end of 2008. The patent contains claims for additional indications including diabetic retinopathy. Furthermore, the patent incorporates the same claims for the additional compounds providing for a portfolio of candidates MacuCLEAR could pursue.
